But Judge Hollington ruled in May that Mr Roberts and future owners of the new house would have an 'implied' right of way over the couple's road. John Antell, for Mr Roberts, said the Parkers' criticisms were 'misplaced' and Judge Hollington had come to the right conclusion.

In his decision, the judge said Mr Roberts and Mr and Mrs Parker 'seemed to be perfectly reasonable people who are not going to come to blows in the future. He added: 'They have just been divided by the no doubt large amounts of money at stake, given the legal uncertainties arising out of the complicated conveyancing history of this case.
